UK Police Seek International Order Regarding Local Disclosure Request

The High Court of England & Wales has declined to overrule a disclosure order granted to the UK Serious Fraud Offices, (SFO) against US-based conglomerate KBR Inc last July in 2017, as a component of a criminal examination concerning suspected bribery and corruption.

The court dismissed the Company’s claims that the notice was ultra vires (outside the powers) as it asked for material held outside the UK, from a US-incorporated company, and rather the SFO ought to have taken mutual legal assistance from foreign authorities as opposed to applying for a disclosure order.
