Spanish Civil Powers to Confiscate of Proceeds From Alleged Corruption Offenses

In Spain Emergency Decree 62/2019 was approved, allowing the authorities to confiscate assets allegedly resulting from serious crimes or corruption.

Previously, only criminal courts had such powers. Now the federal government only needs to provide evidence that there are compelling grounds for suspicion that the assets of the person or the property acquired do not correspond to the level of his income. It will, however, first have to obtain a ‘precautionary measure’ from a criminal court, before starting civil litigation.
