Family Law: Russian Refugee's Wife Accepted for UK Asylum

A Russian refugee case has been setting precedents in the UK after Ms Elena Vasilyeva obtained permission to apply for a divorce settlement in UK courts using Section 13 of the Matrimonial and Family Proceedings Act 1984, despite the fact that her and her husband are both Russian. They spent most of their married years in Moscow, and after seperation Ms Vasilyeva has lived in Tenerife, a small Mediterranean island for the last 4 years.

The England & Wales High Court said none of Vasilyeva’s arguments on their own provided substantial grounds for relief, however being considered together demonstrated a sound reasoning as her husband claimed asylum in the UK back in 2011. (Vasilyeva v Shemyakin, 2019).
