Association for Tax Technicians Warn UK of Non-Resident Surcharge Tax

The Association for Tax Technicians have stated that the UK government could prompt unintended consequences when bringing new legislation into force, by introducing an additional 2% stamp duty land tax (SDLT) for non-UK residents buying residential property in the UK from April 1st 2021. 

The main practical difficulty is that a test of residency, that is generally established for a given period of time, is now being added to a tax on a transaction, which takes place permanently only at one point in time, so that an extra residency test will have to be created only for stamp duty land tax purposes.
