Ireland Refuses to Repatriate UK Tax Fraudster in Recent Ruling

In a recent common law tax fraud case Irish Minister for Justice v O’Connor; the Irish Supreme Court has refused to send an Irish national back home to Ireland, who has been sentenced to a prison term for tax fraud in the UK and fled to Ireland while on bail.

The court rejected the UK’s European warrant for arrest against the perpetrator, due to the UK’s impending departure from the European Union which means he would be at risk of imprisonment in the UK when it is no longer an EU Member State following Brexit.
