Family Law: Swiss Couple Denied Rights to Settle Divorce in UK Court

A new UK family law precedent has been set regarding the classification of the family home or main residence by a couple of Swiss origin. The married couple cohabited in Switzerland for over 20 years until their divorce, and later moved to their second home in London permanently.

The England & Wales Family Court ruled that as Ms Gisena Pierburg cannot launch her divorce proceedings in the UK as during the time of her marriage she only visited the London home for social events such as opera and ballet nights (Pierburg v Pierburg, 2019).
