Canadian Dairy Company to be Taxed in Canada in Spite of Dutch Holding Company

Canada’s Tax Court has made a controversial ruling regarding the tax status of a Dutch dairy farming company situated in Ontario, run by 2 Canadian-resident Shareholders.

The court decided that the organisation’s central administration and control was exercised in Canada, regardless of the fact that the company’s Sole Director is resident in the Netherlands and is indirectly owned by a Dutch couple who relocated to Canada over 20 years ago.
